Acceptance of Terms

By accessing and using this website, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use this website or our services.

Services Description

garnet-petal operates a collective of ceramic workshops offering custom commissioned pieces, workshops, and related services. All work is handcrafted by individual artisans.

Commission Terms

Inquiry and Consultation

Submitting an inquiry through our website does not constitute a binding agreement. Commissions become binding only upon mutual agreement and payment of the required deposit.

Deposits and Payment

Custom commissions typically require a deposit ranging from thirty to fifty percent of the total project cost. Final payment is due before shipping or pickup. Specific payment terms will be outlined in your commission agreement.

Timeline Estimates

Production timelines are estimates based on current workshop capacity. While we make every effort to meet stated deadlines, handcrafted work may occasionally require additional time due to technical considerations or unforeseen circumstances.

Design Approval

You will have opportunities to review and approve designs before production begins. Once production has started, significant design changes may not be possible and could incur additional costs.

Material Variations

Clay and glaze are natural materials subject to variation. Slight differences in color, texture, and finish between samples and final pieces are inherent to the ceramic process and do not constitute defects.

Cancellations and Refunds

Cancellation terms vary depending on production stage:

  • Before production begins: full refund minus a consultation fee
  • During production: deposit is non-refundable; remaining balance refunded
  • After completion: no refunds available

Custom commissioned pieces cannot be returned unless they arrive damaged during shipping.

Shipping and Risk of Loss

We package all items with appropriate materials for safe transport. However, once an item leaves our facility, risk of loss or damage transfers to the carrier and ultimately to you. We recommend purchasing shipping insurance for valuable pieces.

Damaged Items

If an item arrives damaged, photograph the damage and packaging immediately and contact us within 48 hours. We will work with you to file insurance claims or arrange replacements as appropriate.

Intellectual Property

All designs, images, text, and other content on this website are owned by garnet-petal or our artisans and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit permission.

User Conduct

You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any systems or data
  • Interfere with the proper functioning of the website
  • Submit false or misleading information
  • Harass or abuse our staff or artisans

Liability Limitations

To the fullest extent permitted by law, garnet-petal and our artisans shall not be liable for:

  • Indirect, incidental, or consequential damages arising from use of our services
  • Delays in production or delivery due to circumstances beyond our control
  • Minor variations in handcrafted pieces
  • Damage occurring after items leave our possession

Our total liability for any claim related to our services shall not exceed the amount you paid for the specific commission or service in question.

Workshop Sessions

Workshop participants must:

  • Follow all safety instructions provided by instructors
  • Arrive at scheduled times (late arrivals may result in shortened sessions)
  • Understand that ceramic work involves physical activity and potential minor hazards

Workshop cancellations must be made at least 48 hours in advance for a refund. Later cancellations may be rescheduled subject to availability.

Photography and Publicity

We may photograph completed commissions for portfolio and marketing purposes. If you prefer your commission not be photographed or shared publicly, please notify us in writing.

Governing Law

These Terms of Use are governed by the laws of Canada and the province in which the relevant workshop is located. Any disputes shall be resolved in the courts of that jurisdiction.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated date. Continued use of our website or services after changes constitutes acceptance of the modified terms.
